Terms and Conditions

Music recordings are made available free of charge via Mixed Tape for listening to via streaming or for downloading. Every music recording is usually available for six maximum twelve weeks at a time. Artists – as individuals or as musical groups – can send music recordings to Neuland + Herzer GmbH/Daimler AG and have the opportunity to present themselves and their music via Mixed Tape. Neuland + Herzer GmbH/Daimler AG decide which music recordings are to be presented via the Mixed Tape.

Ticket Lottery Pete Philly – Terms and Conditions

(1) Entry to the ticket lottery is available only to persons over the age of 18.

(2) The two winners will be drawn at random.

(3) The two winners will be notified personally by email, not later than 8pm CET on December 2^nd 2011.

(4) Effective participation is only possible if the participant agrees to give information about fore- and surnames of the two persons to be put on the guest list, and if he or she agrees to these terms and conditions.

(5) The names and dates given by the participants will exclusively be used for the ticket lottery and be deleted afterwards. Fore- and surnames of the winners and their companions will be forwarded to a third party only in order to place the names on the guest list.

(6) Transfer and catering is not included in the prize and will not be provided.

(7) Entry to the event can only be granted if the winner arrives at the event location not later than 8pm on December 6^th 2011.

(8) The prize is not transferable and cannot be exchanged for money or money’s worth.

(9) There is no right of appeal.

(10) The ticket lottery closes on December 2^nd at 4pm CET.

Uploading files

Individuals or musical groups, hereinafter referred to as ‘the artist’, provide express assurance that all the music recordings sent to Neuland + Herzer GmbH/Daimler AG – in particular via the Mixed Tape website – are not subject to third party rights and that the artist is entitled to send the music recordings to Neuland + Herzer GmbH/Daimler AG including the licence for Neuland + Herzer GmbH/Daimler AG to use the music recordings for Mixed Tape. The artist furthermore provides assurance that the music recordings are not subject to a collecting society and that therefore no fees will be due to a collecting society for streaming and downloading. The artist furthermore indemnifies Neuland + Herzer GmbH/Daimler AG from all third party claims which are enforced against Neuland + Herzer GmbH/Daimler AG as a result of the music recordings being used for Mixed Tape. Upon sending music recordings to Neuland + Herzer GmbH/Daimler AG – in particular via the Mixed Tape website – the artist allows Neuland + Herzer GmbH/Daimler AG to make the music recordings available via digital channels of distribution for listening to and downloading in accordance with the terms of Mixed Tape. In particular, the music recordings may be made available free of charge for listening to via streaming and for downloading for up to twelve weeks. The artist allows Neuland + Herzer GmbH/Daimler AG to edit the music recordings as follows:

1. conversion of format into .mp3 and .swf
2. inclusion or adaptation of information (text, image, video)
3. change of sampling rate,
4. adjustment of tone for compilation (a Mixed Tape),
5. synchronisation with the Mixed Tape offering in particular with flash and video files.
6. Compilation with other works for a Mixed Tape. File formats permitted for uploading: .mps, .mp4, .ogg, .wma.

The artist allows Neuland + Herzer GmbH/Daimler AG to use all information provided by the artist for promotion, presentation of and advertising for the music recordings and Mixed Tape, particularly for public relations. The artist agrees that his/her contact details will be saved so that Neuland + Herzer GmbH/Daimler AG can contact him/her in the event of clarification being required.

Listening

Streaming

Music recordings may only be listened to via streaming for private purposes. Public or commercial use is not permitted. The music recordings may only be recorded (digital or analogue) for private use. The dissemination of recordings of the music recordings is only permitted for private use. The music recordings may only be changed or edited for private purposes. Please contact Neuland + Herzer GmbH/Daimler AG for public or commercial usage.

Downloading

The music recordings may only be downloaded for private purposes. Public or commercial use is not permitted. The music recordings may only be saved for private use. Copies are only permitted for private use. The dissemination of the music recordings is only permitted for private use. The music recordings may only be changed or edited for private purposes.
